In March of 2024, the Idaho Supreme Court issued a decision citing an article by Susan Park, an associate professor of legal studies in business management. Co-authored with Doug Werth, the article, “The Idaho Human Rights Act Is Long Overdue for a Legislative Update,” highlights how the IHRA has remained unchanged for two decades despite significant federal anti-discrimination laws being enacted. While federal courts treat IHRA cases as identical to federal law, Idaho courts take a more nuanced approach, leading to inconsistencies in how discrimination cases are handled. Park emphasizes this urgency, stating, “Our discussion leads to the inevitable conclusion that revisions to the IHRA are long overdue.”
