Temporary Emergency Hire
A search waiver may be approved to acquire the services of an individual critical to institutional needs when operating requirements are immediate and a public search would result in undue delay or disruption. [Search waivers based on work stoppage are valid only for a period of one year. An open competitive search is mandatory, and must be completed within 1 year of temporary appointment.]
Special Skills
A search waiver may be approved to acquire the services of an individual who’s academic, research, or professional qualifications are responsive to an express need of the institution and are so noted in their discipline as to negate a reasonable presumption that a better qualified candidate would result from an open search. Examples of special skills waivers include (but are not limited to):
Distinguished or named professors or endowed chairs (including visiting professors with benefits).
Research Associates named in grant applications not currently employed by Boise State University (where such individuals’ expertise is critical to proposed research) or who expect to accompany a new faculty member from another institution as part of on-going research activity that will be transferred to Boise State University.
Associate or Assistant Head Coaches recruited concurrently with the public recruitment of a new Head Coach, consistent with the labor market practice that the recruitment of a new Head Coach often entails the de facto recruitment of a coaching team.
Targeted opportunity hire who can especially advance priority mission-driven goals. When a targeted candidate’s many qualifications and anticipated contributions to the university community are reviewed, the individual not only satisfies usual high academic and intellectual standards for membership in the university’s faculty in a discipline of need or interest to the institution, but also is expected to uniquely or especially advance the university’s priority mission- driven goals.
Internal Promotion
A promotional opportunity that may qualify for a search waiver meets
all
of the following criteria:
The individual is an identified successor who has been in the next-in-line subordinate position for a minimum of six (6) months (i.e. Assistant Director to Director); and to which no similarly situated individuals exist.
The individual is
not
moving from a classified position to a professional or faculty position
The individual is
not
moving from a non-managerial position to a managerial position.
Temporary to Regular
The individual is in a temporary assignment where a previous selection process was conducted.
Reinstatement
A search waiver may be approved to reinstate an employee who separated from Boise State within the past 12 calendar months and who is returning to the same or substantially similar role within the same department or division.
Campus Search Only
The campus provides an applicant pool that is substantial enough as to make an external search unnecessary. Note that an external search may still be considered following review of candidates derived from an internal search.
IN ADDITION, there may be
exceptional or unforeseen circumstances that do
not meet any of the reasons listed above, but are of comparable substance and importance which justifies the waiver of a search. By submitting this form, as the hiring official you agree that you have received the necessary departmental related approvals to request this recruitment waiver. This “Request for Search Waiver” form must be completed and include the appropriate attachments before it will be considered. Required documents include:

A written justification detailing each of the following:
What alternative is being requested in lieu of an external search?
Why this alternative is being suggested instead of an external search?
If there is a specific candidate being recommended for hire in lieu of conducting a search, what are the candidate’s credentials, and why is the specific candidate being recommended? Were there any other interested and/or qualified internal candidates for the position? If yes, indicate other interested candidates, their credentials, and provide rationale for not selecting those candidates or why they should not be considered.
If a one-year temporary appointment is being requested, indicate an approximate beginning date when the search process for a regular continuing appointment will begin. Also, indicate all relevant recruitment processes, if any, that were undertaken before selection of the candidate being recommended. If an emergency hire, indicate reasons for an emergency hire.
If a complete waiver of search process is being requested for a regular continuing appointment, be specific as to the rational for recommending regular appointment status and indicate all relevant recruitment processes that were undertaken prior to selection of the candidate being recommended, or the rational for an internal promotion.
