Susan Park, chair of the Department of Management and associate professor of legal studies in business, co-authored an article that was recently published in the American Business Law Journal. The article, “Digital Self-Ownership: A Publicity-Rights Framework for Determining Social Media Rights,” examines the right of employees to control a social media profile and its audience. Relying on the legal concept of publicity rights, it argues that employees should be entitled to protection and post-employment retention of social media unless the work falls squarely within the scope of employment. The American Business Law Journal is an Academy of Legal Studies in Business publication and a leading U.S. business law journal.
